_ Mediation is a method of dispute resolution that is often an effective alternative to the more tradi­tional trial in front of a judge.  Some Oklahoma counties require the parties to attend mediation before the case can even be set for a trial.  The parties and their attorneys meet with a trained medi­ator who attempts to help the parties in reaching an agreement. The parties also have the option of attending mediation without their attorneys.  The mediator tries to facilitate an agreement, but does not force either party to agree.

During the mediation process, both parties should make a good-faith attempt to resolve their dispute outside of the courtroom and agree on issues such as visitation, cus­tody or property division. Neither party, however, should feel that the “agreement” was forced upon him/her.  Mediation is one way the the parties can feel they are more in control of the results of their family law case.  Parties can be happier in the long run if they are able to make the decision to settle their dispute, rather than permitting a judge to decide the case. If it is not possible to reach an agreement the case can then be set for trial.

Who Is the Mediator? Most mediators have either social work or psychology training, although some also have legal training and some have training in all three fields. Many are highly skilled professionals with substantial experience conducting mediations.
