We know that custody litigation is difficult in many ways. We have a suggested

WHAT ARE YOUR RIGHTS TO SEE YOUR CHILD(REN) IF YOU LIVE OUT OF STATE?
If you now live in a different state than your children, you will need to establish a long-distance
visitation schedule. The Court may require you to pay the transportation expenses if you moved,
or it may split transportation costs equitably between the parties.
You will generally need to file any legal action in the state where the children have resided for
the past six (6) months. There are certain exceptions to this rule, and you should consult an
attorney in your state for additional information. If your Decree was entered in your state and
you still live there, your state may retain jurisdiction over the case. (continued below)
If there is an emergency and the children are present in your state, a court
may be willing to take temporary emergency jurisdiction over the case.
